Code of Conduct App

We make available to users of the DoGood application (hereinafter also the “Application”, or “App”) this Code of Conduct (hereinafter the “Code”), in order to provide users with detailed information on accepted and prohibited behavior in the Application and in the Program conducted through it.

The information contained herein may refer to the rest of the application documentation: the General Terms and Conditions, and the Privacy Policy, also accessible from the App. 

Objectives

The code of conduct establishes the performance criteria that must be observed by all users when using the App. The objective of the code is to ensure that all users maintain an ethical and responsible behavior during the use of the application and the development of each Program, and to guarantee the enjoyment of the software functionalities by all.

To this end, the principles and values that should govern user interactions and the consequences of non-compliance are defined.

Permitted behaviors

  • The use of the App is allowed for the registration of actions related to the purpose of the Program and to the concept of sustainability.
  • The publication of photographs as evidence of sustainable actions is permitted.
  • The publication of comments as evidence of the implementation of sustainable actions is permitted.

For these purposes, “sustainable action” is considered to be any action carried out by the user that promotes responsible habits with the environment and/or its social surrounding, as well as advice that promotes sustainability among the community, understanding sustainability in a broad sense.

Prohibitted conducts

It is not permitted to access or use the App for illegal or unauthorized purposes, with or without economic purpose and, more specifically and without the following list being absolute, it is prohibited: 

  • Use the App in any way that may cause damage, interruptions, inefficiencies or defects in its functionality or in the computer of a third party; 
  • Use the App for the transmission, installation or publication of any viruses, malicious code or other harmful programs or files; 
  • Use the App to transmit or publish any material of a defamatory, offensive, racist, vulgar, denigrating, pornographic, or obscene or threatening nature or that may cause annoyance to any person; 
  • Use the App in a manner that constitutes an infringement of DoGood’s or any third party’s rights; 
  • Use the App illegally, against good faith, morality and public order; 
  • Use the App to transmit material for advertising or promotional purposes, including spam, chain letters or similar; 
  • Use the App to collect personal data from other users; 
  • Accessing the App under a false identity, impersonating a third party or using a profile or performing any other action that may mislead other users as to the identity of the origin of a message; 
  • Unauthorized access to any section of the App, other systems or networks connected to the App, any DoGood server or services offered through the App, by hacking or spoofing, password mining or any other illegitimate means; 
  • Breach, or attempt to breach, the security or authentication measures of the App or any network connected to the App, or the security or protection measures inherent in the content offered on the App; 
  • Take any action that causes disproportionate or unnecessary saturation of the App’s infrastructure or DoGood’s systems or networks, as well as systems and networks connected to the App; 
  • Impede the normal development of an event, contest, promotion or any other activity available through the App or any of its functionalities, either by altering or attempting to alter, illegally or in any other way, the access, participation or operation of those, or by falsifying the result thereof and/or using fraudulent participation methods, by any procedure, and/or through any practice that violates or infringes in any way these Terms and Conditions. 
  • Post photos or comments not related to the purpose of the Program or to the concept of sustainability or sustainable actions.
  • Post photos or comments that do not reflect an actual action taken by the user.

Types of faults

They constitute minor offenses:

  1. Posting a photograph or comment that does not comply with the challenge instructions.
  2. Publication of a photograph that complies with the challenge instructions, but which comes from a source external to the participant (e.g. photograph or video taken from the Internet, when the action must be carried out by the user him/herself).
  3. Publication of sustainable actions of third parties, when the action must be carried out by the user himself/herself.
  4. Publication of the same photographs in different challenges.
  5. Posting a photo that is blurred or where it is difficult to identify its content.
  6. Posting photos or comments that are not related to sustainability.
  7. Posting photos or comments that do not reflect a real action carried out by the user.
  8. Posting photos of people who have not given their consent to appear on the app, and photos of minors without proper consent.

Serious misconduct:

  1. Repetition of minor offenses (2 offenses).
  2. The publication of a photograph or comment with inappropriate content, which does not comply with the requirements of the challenge and which may offend the sensibilities of the participants, constitute a lack of respect or violate the dignity of people, as well as mentioning or uploading content in any format that is offensive to any type of group: people, animals, groups, associations, other users, etc.
  3. Publication of any type of propaganda.
  4. Publication of any speech that promotes hate or goes against the values promoted by the company. 
  5. The publication of a photograph with illegal content, or that constitutes conduct prohibited by this Code.

Application of the Code

In the event of any violation of the Code and the General Terms and Conditions of Use, DoGood reserves the right, together with the App licensee Client, to take appropriate disciplinary action, and to bring to the attention of the courts any behavior it deems worthy of such action. 

Minor offenses will be resolved as follows: 

      • The challenge where the content has been published will go to “Locked” status. 
      • The user will be subtracted the points obtained for this challenge, if he/she has points in the wallet.
      • In the event that these points have already been donated or voted, they will be subtracted from the ranking points, lowering positions in the ranking.
      • A moderator will review the post and if deemed appropriate, the user will be given the option to repeat the challenge.

Serious misconduct will be resolved as follows:  

      • The challenge where the content has been published will go to “Locked” status. 
      • The user will be subtracted the points obtained for the challenge. 
      • In the event that these points have already been donated or voted, they will be subtracted from the ranking points, lowering positions in the ranking. 
      • The challenge will remain locked for that user until the end of the Program.
      • The moderator will contact the Client to inform him/her of the fault.
      • In the event of repeated misconduct, and depending on the nature of such misconduct, the moderator may agree with the Client to block or permanently suspend the user’s account, until the end of the Program.

* All of the above will be related to any type of publication, challenge, self-challenge, comments, or any type of information that the user shares in the application.
